Vexatious Litigation: Is Halle Berry Using Family Court System to Bully Gabriel Aubry?

According to Wikipedia, vexatious litigation is "legal action which is brought, regardless of its merits, solely to harass or subdue an adversary. It may take the form of a primary frivolous lawsuit or may be the repetitive, burdensome, and unwarranted filing of meritless motions in a matter which is otherwise a meritorious cause of action. Filing vexatious litigation is considered an abuse of the judicial process and may result in sanctions against the offender."

I LOVE this term..."vexatious litigation." It so appropriately describes how someone feels when when an ex uses the family court system to abuse . It is distressing, annoying, harassing and meant to subdue someone. Who does such a thing? Someone who's desire to control outweighs their own common sense.

Take for example the latest in Halle Berry's ongoing legal drama with her ex, Gabriel Aubry. On top of a Thanksgiving Day brawl between her ex and now fiance, Olivier Martinez, Berry has been busy over the last couple of years filing one complaint after another against Aubry.

Berry has left no stone unturned in her attempts to malign Aubry's character and limit access to his daughter. She has accused him of not properly caring for the child while in his custody. She had to be court ordered to add Aubry's name to the child's birth certificate. And recently petitioned the courts to allow her to move to France with the child. Something the court ruled against.

Not only does she use the family court system she is quite open with the press when it comes to her ex's faults and her concerns for her daughter's safety. Aubry, on the other hand seems mainly concerned with his daughter's well-being and having the legal right to parent her.

Maybe Berry finds it vexing that the family court system has failed to respond in a positive manner to her stardom and wealth. Could that be the reason she feels the need to engage in "vexatious litigation?"

There isn't much difference, aside from fame and wealth between Berry and others who use the family court system to abuse. It all boils down to an attempt to control the situation in a manner that suits them and to hell with the needs of anyone else.
