In Virginia there is no such thing as a "legal separation." The courts can grant a "limited divorce" or a divorce from bed and board which does not bring an end to the marriage but allows couples to live separately with the protection of the courts. During the limited divorce period neither spouse is allowed to remarry or abuse marital property that has not been protected by a court order.
A limited divorce serves only to protect the separation period and provide for support of any children produced by the married and either spouse who may need spousal support. There is no set time limit for a limited divorce, spouses can live separately as long as they wish before filing fora divorce or re-uniting.
Also, a limited divorce is not a requirement of laws. You can get a divorce whether you have been separated or not in the state of Virginia.
