Contempt of Court Defined

Definition:

Contempt of court is a legal action brought against the plaintiff or petitioner when they allegedly and willfully defy a court ordered judgment. If your ex-spouse fails to make child support payments you are entitled to file a motion with the courts requesting a hearing on the matter.

If found guilty of contempt of court your ex-spouse will either be given the opportunity to comply with the violated court order or will be sent to jail until he complies with the order.

Examples of Contempt of Court:

  • A non-custodial parent refuses to pay child support as outlined in the final decree of divorce.

  • An ex-spouse defies the final decree of divorce by not paying ordered spousal support payments.

  • An ex-spouse refuses to pay their portion of any marital debt as specified in the final decree of divorce.
