Contingency Fee Defined

Definition:

An unethical type of fee agreement that provides the attorney with a percentage of your settlement of judgment. No attorney should take a percentage of your settlement or judgment in a divorce case. A non-spouse should not share in the division of the marital estate.

If you interview with an attorney who wants a contingency fee you are best served not to do business with him/her. Such fees in divorce cases are prohibited by the Canons of Ethics in most states. Always deal with an attorney who has legal ethics.
